Part ( A) - General Section

1. scope of application; time periods

1.1 Business dealings and deliveries are made exclusively on the present Terms. Conflicting or deviating Terms are not applicable. All of our services and deliveries, including all future services and deliveries, that are offered on the internet page shall be governed by these general terms and conditions. The following terms and conditions shall also apply exclusively if we are aware of conflicting or by the following terms and conditions deviating conditions, but nevertheless deliver or perform without reservation.

1.2 If these Conditions mention "consumers", these are natural persons, where the purpose of the order can not be attributed to a commercial, independent or freelance activity. "Entrepreneur" on the other hand are natural or legal persons or partnerships with legal personality, the order for commercial, independent or freelance purposes. "Customers" within the meaning of these Terms and Conditions are both consumers and entrepreneurs .

1.3 If deadlines are specified as working days, those are including all weekdays except Saturdays, Sundays and public holidays.

2. Registration on www.yomats.com

2.1 When you enter your personal information required for registration you are responsible for the accurate and complete specification. You are obligated to treat the personal access information confidential and to not pass these to unauthorized third parties. Confirmation of registration follows immediately after sending the application by clicking the button "Register for free" or "Sign up".

2.2 With your access data you can log in below www.yomats.com .

2.3 You are solely responsible for content that you publish within accessible areas. This may not infringe the rights of third parties. An entitlement to storage, or publishing your uploaded content, such as product reviews, does not exist.

2.4 Each customer is only entitled to one customer account. We reserve the right to delete multiple registrations and members who violate 2.1 to 2.3 of the provisions referred or to warn, to terminate, delete or edit content (Virtual house right).

2.5 We are not obligated to accept the registration or the appointment of a registered customer. We are not obligated to keep our offer permanently available. Confirmed orders remain unaffected.

You can also print or save this document by using all the usual functions of your Internet service program (= browser: usually "File" -> "Save As") use. 

3.2 You can also additionally save the data of your order simply by either downloading the Terms and save on the last page of the order process summary from the online store data using the functions of your browser or you are waiting on the automatic order confirmation, which we will send to you also via Email after completion of your order. This order confirmation email again contains the data of your order and our terms and conditions and can be easily printed out or saved using your email client.

3.3 Your data will be stored by us, but are not immediately available for security from you. We offer a password-protected direct access ("My Account") for each customer. Here you can view and manage your address data, any number of data and an eventual newsletter and save with appropriate registration information about your closed, open and recently shipped orders.

4. Language and Conclusion

4.1 Contracts for products, which are offered under www.yomats.com, can be closed exclusively in German language. We do not offer products for sale to minors. If you are under 18 years, the participation of the parent or guardian is required.

4.2 "buy now" By clicking the button you are giving a binding order of the items in your shopping cart. The confirmation of the order follows immediately after sending the order. All products are sold only in small quantities.

4.3 A binding contract takes effect with the submission of the order confirmation, but no later than upon delivery of the goods ordered. You are - regardless of the right of withdrawal for orders as consumers already existing - bound for two working days to your order if the designated goods are "available". Moreover, the bond is longer than 5 days.

4.4 If your payment is not received despite being in arrears, even after a second notice served to a time of 7 calendar days after sending the order confirmation from us, we withdraw from the contract with the consequence that your order has lapsed and we shall take no obligation to deliver. The order is then done for you and for us with no other consequences. Therefore a reservation to Article Prepayment payments done for a maximum of 7 calendar days.

5. procurement risk; Elimination of the obligation to deliver; Extension of delivery times; Transfer of Risk

5.1 A procurement risk is not accepted by us, even with a purchase agreement for a generic commodity. We are only to deliver goods from our stock.

5.2 The obligation on our part to supply does not apply if we ourselves are supplied correctly and on time despite not properly congruent hedging transaction as well as the lack of availability are not responsible, we have to be informed about this immediately and we have not assumed a procurement risk. In case of unavailability of the goods we will refund any advance immediately.

5.3 The delivery time shall be reasonably extended in the delivery debilitating circumstances of force majeure. 7. Governing Law; Jurisdiction

7.1 All legal transactions or other legal relations with us - and when ordering YoMats articles - The law of Germany. Part (B) - Order of YoMats-Products

1. Contractors

When ordering YoMats articles is your exclusive contractual partner YoMats GmbH, Argentinische Allee 162B, 14169 Berlin. For an explanation of YoMats articles, see the preamble to these Conditions.

2. Prices, shipping and express shipping

2.1 The prices quoted in the offer at time of order. The stated prices are final, which means they include the currently valid German VAT and other price components.

2.2 We take care of the shipping costs with a purchase value of €100, except for express shipping.

2.3 We offer an express delivery for certain orders. Whether this option is available for your particular order , you can see in the ordering process. The cost of express delivery amount to 5,90 EUR. The goods will be delivered no later than 2 business days. Should this delivery time be exceeded, the delivery costs will be refunded.

3. Payment , delivery times , delivery partners

3.1 We offer the payment methods Credit Card and Paypal. We reserve the right on every order not to offer certain payment methods, and to refer to other types of numbers.

3.2 You agree that you will receive invoices and credit notes in electronic form.

3.3 In case of purchase with credit card we charge your credit card account when the delivery of the order is carried out.

3.4 Please note that we only accept payments from accounts within the European Union (EU). In no event will we assume the cost of a cash transaction.

3.5 The purchase price is payable on purchase on account on the date of the delivery to the customer to pay.

3.6 If the customer is in default of payment, we reserve the right to charge overdue fines as lump sum settlement amounting to EUR 5.00 per reminder. You will be given proof that a lower damage than the lump sum or no damage.

 3.7 We use the DHL for deliveries.  

4. statutory right of withdrawal when buying YoMats articles

4.1 Below you will receive the legally required instruction about the conditions and consequences of withdrawal. In case of return, you can use the attached purchase return label or use the printable return label under www.yomats.de. If you have problems with downloading the return sticker or you have no printer available, please contact our customer service. If you need a new return label, we would ask you, to request this by e-mail to info@yomats.com. Please help us to avoid unnecessary costs and do not send the goods back unfree.

Please note that the following cancellation only applies to the purchase of YoMats articles.

Conditions:

You have the right to withdraw within fourteen days without giving a reason.

The withdrawal period shall be fourteen days from: - the date on which you, or a representative of your third party, other than the carrier, the last goods has taken possession; or- Buyer probationer from the date on which the approval has been made. The approval shall be deemed made if you do not verweigerst the contract within a 7-day approval period. You have to return the goods immediately and in any event not later than fourteen days from the date on which you teach us about the cancellation of this contract to us or to hand over. The deadline is met, when you send the goods before the deadline of a fortnight.

You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund.
